Time required to grant visa after allowing appeal?

Post by sonyasking » Sat May 11, 2013 2:21 pm

Hi,

Can you please share your experience that how long I have to wait to get visa/ILR after allowing appeal (ILR)? Can I contact UKBA after two weeks of determination?

My appeal is allowed but on different ground than I claimed. Still I will get ILR in this case too? For instance, I said there is technical error on decision on counting the date etc., but the judge pointed out that the decision given by UKBA to remove us from the UK at the same time of the rejection of ILR (joining them together) was wrong. And he gave the decision "appeal is allowed because the decision given to remove him out of the UK was not in accordance with the law" - can you tell me that means I can be confident I got the ILR whatever the reason she has given - overall, I appealed against ILR rejection, and the appeal allowed..

Thanks.

you will get your ILR.

these days when ever case worker refuse an application they do put decision to remove.

In my appeal as well Judge said decision to remove is totally illegal.

well to get your ILR fast. you have to give them some pain.

You have to keep writing them asking to expedite the process. other wise no budy can tell how long UKBA will take.

I start complaining and received ILR after 4 weeks. so up to you when you want to start

Many thanks for your suggestion.

I am eligible to apply for out of date application for leave extension too (I think within 28 days). That is why timing has been important.

Since as you said I will get ILR, I do not have to bother about the second route. I will keep them asking; but what if I go in person with appointment (possibly with out of date application though it will be no use, ..just to get an appointment..) and discuss with them?

Thanks

yes you can try that...

but if you go .. please do take print out of laws and guidance notes.

UKBA staff is dumb.

i have seen on this forum people have taken print outs and still argued with staff that they were right.....
