Hi,
I have been working with my current employer in the same position for the last 3 years under the Tier 2 Visa. I recently got my extension done for another 3 years with the same employer. However, yesterday I have been told by my employer that he is selling his business and that he will be unable to accomodate me in his other existing businesses. However he will be glad to recommend me to the new owner. I have gone through some guidelines of the TUPE (Transfer of undertakings Protection of Employment)
My queries are :
1. In such case will I have to apply for a new leave to remain with the new owner or just an intimation to UKBA will suffice?
2. As per TUPE, the employees of the old employer automatically become the employees of the new employer unless the employee chooses to opt out of the company. Correct me if I am wrong.
3. As per TUPE, the terms and conditions would remain the same, however the new employer should have a license too. Correct me if I am wrong.
4. Is TUPE applicable on all kinds of business. I am in the hospitality industry.
