When to apply for ILR

Post by sundeep1984 » Sun May 12, 2013 12:42 pm

Good afternoon all

My wife has came to uk on spouse visa.

She got the Visa is April but came to UK in July for month, then again in december for full time

Just wondered when does the 2 year thing start before she can apply for ILR
Is it from July or December?

You appear to have a problem in that your wife won't be able to show proof of joint address in the UK for the 2 years duration of her spouse visa. She will have an 8 month gap.

8 months that equates to roughly 240 days

I read if she is in uk more than 270 days she will need extension

So does that mean she is safe?

I read this here

The link u have posted is not applicable for ILR but for naturalisation.

Your wife needs to complete 2 yrs or 5 yrs depending in her entry.
Thanks!

The ILR application asks for proof of joint address to be submitted covering the full 2 years. Why didn't your wife settle here until December?

ahh makes sense

Basically she was in Australia where she got the visa from. We was married then but the indian wedding was in december and till indian wedding is not done we cant live together :(

Thats the reason for gap between her getting visa and coming to UK to settle
