ILR Dependents

Post by rojo » Wed May 15, 2013 4:43 pm

My ILR is due in Sep-2013.
I got married in Dec-2010, as my wife already got Tier 1 visa i didn''t changed her into my dependent until Dec-2011.
Is she eligible for ILR in Sep-2013 as my dependent???
By sep-2013 she will be completing only 21 months but
as per new rule is she need to be in dependent visa for 2 years (24 months)???

Any experts please advise>>>>>

Thx..

Previous answer is correct, unless you are granted ILR under Long residence.

Hi Vinny,

Do you mean that we both can apply to ILR at same time i.e. Sep.2013 even though she is not on my dependent visa for 24 months or 2years!!!!
My wife dependent visa runs from Dec-2011 to Sep-2013 before that she is in UK with Tier 1 visa.
We both are in the same house since 3 years.

Thanks,

vinny

Yes. However, you may have to educate the caseworker in basic logic.
