Travelling while holding a Tier 2 visa

Post by Hasmik » Wed May 15, 2013 10:22 pm

I am in the UK on a Tier 2 visa (with my wife and kids as my dependents). However, I am planning to take an unpaid leave for nine months from fall 2013 to spring 2014 and leave the UK for the duration of that period. (My visa is valid until 2015.)

Does this mean I (or we) am going to lose my visa should we leave the UK for such a long period.

If yes, what is the maximum amount of time one is allowed to leave the country?

Yes, I think it's 60 or 90 days, read Tier 2 policy guidance.

Pretty sure I read that if you have a leave of absence of more than 30 days....

Cant seem to find it now though - surely it's in the guidance somewhere??

Absences from the UK
221. The UK, Channel Islands, Isle of Man and Republic of Ireland form a common travel area. If you leave this area while you are employed in the UK (for example, for holidays, business trips or a secondment overseas), you do not need to make a new application to return to the UK unless your leave expires or lapses.
222. Please note that if you have been assigned a multiple entry Certificate of Sponsorship, this does not override the rules on periods of unpaid leave which are described in paragraph 226 below.
223. If you have been granted entry clearance, or leave to remain for more than six months, your leave will not lapse when you leave the common travel area if you continue to be employed by, and have not ceased working for your sponsor for a period of one calendar month or more (see paragraph 226 below), unless your leave passes its expiry date or you stay outside the UK for more than two years.
224. However, if you do not have entry clearance or you have leave to remain which was granted for less than six months, your leave will lapse if you leave the common travel area.
225. It is important to make sure that if you are travelling overseas for any reason that you fully understand the implications of your leave lapsing or expiring while you are overseas.

Curtailing leave
226. We will curtail your leave in the following circumstances: •If you fail to commence working for your sponsor; or •If you cease to be employed by your sponsor.
227. We may curtail your leave if
