Apply to Tier 2 General Outside UK

HI-

I am in UK under ICT Long term staff after 2011 Rule, can I go back and immediately apply for Tier 2 General ? OR

What Can I do to change my Sponsor and not get a break of 1 year.. ?

I know I have asked many questions recently. can someone let me know what can be done to change sponsor without being away for 1 year

Can you switch into Tier 2 (General)?

If you currently have permission to stay in the UK under any of the following immigration categories, you can apply to Tier 2 (General) from inside the UK:
1- any Tier 1 category
2- Tier 2 (Sportsperson)
3- Tier 2 (Minister of religion)
4- Tier 2 (Intra company transfer: established staff), if you are applying to switch sponsor
5- Tier 2 (Intra company transfer) under the Immigration Rules n place before 6 April 2010, if you are applying to change sponsor
6- any Tier 4 category
7- Tier 5 (Temporary worker - creative and sporting), for a job as a professional footballer - but you must meet the Tier 2 requirements, including English language
8- dependent partner of a Tier 4 migrant
9- Highly Skilled Migrant Programme
10- innovator
11- Fresh Talent: Working in Scotland Scheme
12- International Graduates Scheme (or its predecessor, the Science and Engineering Graduate Scheme)
13- Business and Commercial work permits (except multiple entry work permits)
14- Sports and Entertainment work permits (except multiple entry work permits)
15- Jewish agency employee
16- Member of the operational ground staff of an overseas-owned airline
17- minister of religion, missionary or member of a religious order
overseas qualified nurse or midwife
18- person writing up a thesis
19- postgraduate doctor or dentist
20- representative of an overseas business
21- representative of an overseas newspaper, news agency or broadcasting organisation
22- student
23- student re-sitting an examination
24- student nurse
25- student union sabbatical officer

If you are not in any of these categories, you must leave the UK and make your Tier 2 (General) application from abroad


Since you are under ICT long term staff then you need to apply from abroad. In this case, 12 months cooling-off period applies to you.

According to the guidelines...

you will not be able to re-apply to return to the UK
under an Intra-Company Transfer category

Which means I can apply in Tier 2 General Category -- Correct ?

You can only switch to Tier 2 General from abroad. However you must wait for 12 months cooling-off period before you apply for Tier 2 General from abroad since you were last under Tier 2 ICT long term staff.
