Hi,

I am Balachandran Kulanthaivel currently living in UK as settled person with ILR from Jan 3 2013 onwards, previously i was with (HSMP VISA (2 YRS 2008 & 2009) -> Tire 1 GENERAL PBS (3YRS 2010, 2011, 2012).

I am planning to bring my Family back to UK (Wife and 1 Child) from India. I need some help in understanding which form (VAF4 or VAF10) i have to use for my wife and Child's visa.

My Wife and Child previous stayed with me in UK as my Dependant's under HSMP and TIer 1 general PBS visa.

My wife :

HSMP VISA PARTNER ( 2008 & 2009)
Tier 1 (Dependant) Partner ( 2010 - Jan 15 2013)

My Child :

HSMP VISA CHILD (2009)
Tier 1 (Dependant) Child (2010 - Jan 15 2013)

Due to my Child's health, my wife and child has to stay in india for long and i couldn't bring them in time for their Visa Extension. But now i like to bring them back to UK.

But i am confused with the information given in below link from ukba site.

" You cannot apply in a partner category if you:

are the spouse or partner of a person who is settled in the UK or has British citizenship if their most recent permission to stay was under tiers 1, 2, or 5 of the points-based system; and
you do not qualify for settlement yet.

Instead, you must apply as a dependant under the relevant category of points-based system.

If you made an application to enter the UK on or before 8 July 2012 please see the Partners who applied on or before 8 July 2012 pages. "

Can anybody help me in understanding, which form to choose (VAF4 or VAF10) ?.

The UKBA website is badly worded. Settlement is the correct category for entry clearances, as your wife does not have any current leave.

Hello sir,

Thanks for the information sir. So it is VAF4A form and i have one more query. I have planned to show only my Bank statement, payslips, p60s (original and attested, as it is ready) as Financial proof, i can show the funds and source of income with my documents and i am mentioning in my Sponsor letter as that i will take care all the expenses. Will it be enough or i need to show my Wife's bank account statement as well. She is not working and i am the one sending money to her account.
