Tire 1 general dependent visa for Newborn visa

Post by harry2511 » Sat May 18, 2013 9:08 pm

Hello. I am Indian citizen. I and my wife have got tier1 general visa extension in March 2013. I am due for ILR in March 2015. My wife is expecting baby in July this year. I know I have to apply Indian passport for little-one ASAP. If anyone can help me and provide answer to following questions will be really great.

1) I have checked visa fee for tier 1 dependent presently, it is around £1500 (by post) and £1920(PEO application). The application fee if I apply from outside uk (i.e. India) is £840. I was planning to apply from India as it is cheap but I am confused

a) is this going to create any problem in visa application for my baby?

b) is this going to raise any issue when I apply ILR for baby in March, 2015 with me (with present rules)?

c) Is traveling outside uk with no visa for little one will create any problem at immigration control at uk or india?

2) What documents do I need to apply visa for new one (when I apply from India or from UK) ?

Many thanks for help in advance.

1) If you dont travel outside UK your baby not required any visa or passport.
I am not sure about the visa fee.
a) It doesnt create any problem, you may need extra documentation if you apply from India.
b)NO impact on ILR, it doesnt matter.
c)No problem if you are travelling to your home country which is India in your case.
2. you need the same documents as your dependant.
a.Birth certificate
b.3 months bank statements with more than 600£.
c.Pay slips.
d.Tenancy agreement ( Optional)
e.TB screening certificate ( If you are applying from India)
f. You and your wife passport and BRP card photocopies.
g.2 passport size photos

Let me know if you need more help.

Thanks,
uday

Hello Uday. Many thanks for information and help. Regarding TB screen, Do you know if TB screening certificate from NHS UK will be valid when I apply from India.

I also believe when I will apply ILR for baby, recent rule which came into affect in 2012 mentions something like dependent needs to live in uk for 5 before they can apply for ILR. Will it be applied on baby's application? Just for information I am living in uk since 2005 and wife is living in uk with me since 2011.

if you baby born in UK, he/she will be eligible of BC once you get ILR.
If the birth happen outside UK, the usual dependant rule will apply...
