Tier 2 Visa rejection

Hi,
I applied for my Tier 2 visa while I am on my PSW. Now I got a rejection from UKBA saying that I failed to prove that I am automatically eligible for claiming english language points. When I submitted my postal application, I submitted my BRP card & the letter from UKBA when they had granted the PSW. And in the Tier 2 application it is mentioned clearly that if I am on my Tier1 post study work permit I am automatically eligible for claiming the points towards english language. Because its obvious that I studied here and got my masters degree before I got my PSW.

In the return letter after the rejection it is mentioned that I am not eligible for appealing. Can any one help me with these queries.

1. Is it possible for me to do another application?
2. Is it possible for me to go for an appeal against their decision?
3. Am I still eligible to stay and work here as my current visa is still valid till 2014 january.

where exactly is this mentioned on the application form?

No where it is specified that you will get points for English automatically. You will need to prove that by providing that you did study in UK.

No where it is specified that you will get points for English automatically. You will need to prove that by providing that you did study in UK.
Totally agree with muhdkhokhar.

Do not assume that you will score 10 points on for English language, simply because you are switching from Tier 1 (PSW) to Tier 2 General.

In the following link, it says that you will automatically score 10 points if you are Tier 1 (General) or Tier 1 (Entrepreneur). It does not mention Tier 1 (PSW).
