ILR qualified period --when can I apply?

Post by ldbright » Wed May 22, 2013 1:49 pm

Hi everyone

This is my case and I am looking for some guidance.

I am on Tier1 G and my initial application was made on April 2009. So by April 2014, I will complete my 5 years continuous stay. However, I made a 2nd extention last year which brings my T1 expiry date to Dec 2014.

My question is: can I still apply ILR in April 2014? Or I have to wait till Dec 2014 due to the 28 days rule?

Any thoughts/ help are welcome.

Thank you in advance.

You can apply in apirl 2014.
So the bottom line is you have to be in the UK contiguously for 4 years 11 months and 2 days. I hope this should clear all you confusion.

If your 1st entry was within 3 months then yes you can certainly apply before 28 days of the ILR eligibility date.
