Guaidance on Partner Visa

Hi everyone!!!

Hope u guys can help me.

I am a british citizen (naturalization).
I got married 3 years ago abroad, and since then I am living with my husband overseas.
Now I am pregnant.
As the partner visa application for British citizens has become really hard I am confused what to do??? Since I have to now apply for 2 persons visa :-)

If I go to UK alone and give birth in UK so I can get a British Passport for my child Then only my husband is remaining.
I have several options:

1. After giving birth in UK, I shall come back overseas and apply for my partners visa. This will make it easier for me since I dont need to add my child in the application.
OR
2. My husband to apply to a university and get a Tier 4 Student visa after he came to UK. We apply for Partner visa and change his visa category.
OR
3. I have heard there are some rules to as if I go to another European country I can apply for partner visa and they will give a 5 years visa. Is that true? if true, Can my husband come with me to UK & get settlement visa (after how many years)?

Please can you tell me which one of the options are faster since I know that for option 1 I need to provide financial proofs etc.

As you are British other than by descent, your child will automatically be British when born abroad so no visa needed. However, the disadvantage is the child would be British by descent and thus could not pass British citizenship to their child if their child was born abroad. Not sure whether that matters to you?

Your partner could come to the UK on a student visa and change to flr(m) spouse leave to remain but would still have to meet the new financial requirements.

The EEA option is good if you can work/self employed in another EEA country for 3-6 months first, it's also cheaper and less strict per se. It would take 5 years for your partner to be settled in either the EEA route or the spouse visa route. Once settled he could apply for naturalisation immediately providing he met the other requirements.

Many thanks D4109125 !!, that's cool I didn't know that my child will be a British citizen even though born abroad.

Regarding the UK spouse visa through either applying from abroad or from inside UK using the form flr(m). How long will it take since UKBA here mentions 3 years is required for British citizenship.

Further questions for me to get clear on the the EEA route.
I have to go to say France alone and after I find a job. I have to get a visa for my husband to join me in France. After 3-6 months stay we can go to UK together. After 5 years stay in UK he can apply for a Settlement visa not a British citizenship?

You need 5 years under leave to remain as a spouse before you can apply for settlement, only after settlement can you apply for naturalisation.

Regarding the EEA route it's called the surinder singh rule if you require further information you can post under the EEA route part of the forum. Your partner could accompany you as the spouse of an EEA national.
