Child Status - PIO VS OCI

Post by anandh79 » Fri May 24, 2013 9:19 am

Hi,

My child was born in UK when we had tier 1 status. So we had got her indian passport.

Now the parents are in ILR and we did not apply for the child since we can directly apply BC for her since we both are in ILR.

My confusion are the following.

Once my child has attained BC and British Passport

1. Can she apply of OCI ? Some of my friends told that she will be eligible only for PIO and not OCI, is it true?

2. There are some blogs mentioning about minor helding indian passport? In that case, can she retain the indian passport?

3. Even if she is eligible for OCI, is there a rule where the parents should have BC before making their child applying for OCI

Please clarify as I will be applying for BC for my kid.

Regards
Anandh.B

1. PIO
2. No
3. Minor is not eligible until parents obtain OCI
