EU citizen Moving to Ireland with NON-EU citizen NEED help!!

Post by hafteem » Sat May 25, 2013 12:06 am

Hi,

Am Italian citizen married with my Jordanian husband "Non EU" for more than 6 month, we live in Italy now and he hold an Italian Permanent resident card, we are planing to move to Ireland in June, later we discovered he can't travel without entry visa to Ireland, so we applied to Irish Embassy last Friday and we're still waiting for visa after making my problems to no accept the visa application.

After we travel to Ireland, I have to register myself and my husband in police office "Grada", then get PPS number for both, later I have to apply for my husband a EU1 "STAMP 4 FAM EU" in INIS, as European I have the rights to reside in Ireland under the "Directive 2004/38/EC" law by one or more of the following regulations:
1. Employment.
2. Self-Employment.
3. Study.
4. Involuntary unemployment.
5. Residing with sufficient resources.

so we decide try to apply as "Residing with sufficient resources" regulation cos it very hard to find job and the recession in Ireland, however, am Freelancer Journalist work for many newspapers and magazines and I can work anywhere,as well as i have a good income around 23k euro and have saving amount and a flat in Rome, my husband un-employed for now and he has a good chance to find job in Ireland regarding to his skills in IT, my QUESTION is:

IS a good idea to apply "Residing with sufficient resources" regulation with above evidences or they may refuse the application? please any suggestions!!

I can provide the following:
1. Evidence of financial resources from Italy translated to English.
2. Bank statements from Italy.
3. Employment Letters form news agency in English.
4. Evidence of Ownership of the my property in English.
5. Letter for my parents that can support us with their bank statements.

Is that enough or they can refuse? please help!! :?: :!:
last thing, I have a diploma to teach Italian for foreigners is that can help also to mention with application.

Thanks in advance.

If you have an income of 23k from self employment this is sufficient to live on.

So apply as a self employed person. Mention the additional resources also, but apply as self employed. This is more difficult to refuse than 'sufficient resources' and there is no real definition of how much money you need for 'sufficient resources'.

Within three months you need to register with the tax/revenue office as a self employed person. Register as soon as you have accommodation. Then keep a record of payments for work and costs so you can complete the paperwork showing how much profit you earned.

The good news is that if you register as self employed and pay the tax on the income in Ireland, this means you can get maternity benefit here if you have a baby (there is a waiting period for this right, but it is shorter for the self employed woman than for the woman who works as an employee). If you accept payment of maternity benefit when you have a baby you can't work or take any self employment work at the same time. So some women choose not to accept the maternity benefit money, as they get more from employment.

It is common for those who are self employed to work as an employee also. The diploma in teaching Italian is not a help, but if you get a job as an employee this is good because it is easier to proove than being self employed. So if you can get any job - teaching, working in a shop - you should consider taking the job.

Your husband will need health insurance (you do not need this, but can buy it if you want). The cheapest will do. Buy this in the first three months, as it may be asked for when he is looking for Stamp 4 EU family.

PS: I don't have fix salary per month.

There is no stated 'minimum amount' for sufficient resources, but I think that if you can show more than the amount of social welfare paid to the poor then you are showing that you do not intend to rely on social welfare money from the state.

The amount in that case is 188 for you and 124 for your spouse, per week, plus the cost of whatever accommodation you choose to have, plus the cost of health insurance.

Note that this is not stated anywhere, but if you meet the above amount you would definitely be over the limit, as the Irish state considers this sufficient for its own citizens to live on.

Re: Tax - if you have income from Italy on which you pay tax in Italy, also work on a part time basis (teaching Italian perhaps) in Ireland, and your husband works here also, then you need to consult a taxation expert, as your tax obligations become confusing.

If your husband works in Ireland that adds to your financial resources, so that helps.
