ILR Deferred – What to do with Dependant Visa? Please advise

ILR Deferred – What to do with Dependant Visa? Please advise

Hi,

I applied for ILR on 07/03/13 at Sheffield PEO where the decision was not made on same day and I was requested by Case Woker to send Contract Agreement with clients in order to further support my application. I managed to send contract agreements on 15/03/13 and since then I have not got any reply from UKBA. I am on TIER1 and my application was based on Employment + Self Employment. Although I had an appointment at Sheffield PEO but I was asked to send contract agreements to Croydon (dont know why....)

It has been already two months now and I still dont know how long they would further take to decide my application. I am in unlikely position as I have got two dependants who visas are going to expire on 08/06/13.

In case if I still dont get any feedback in next few days or so. Therefore, I would be thankful if someone can answer the following queries:-

1. Can I apply for my dependants ILR while my application is still pending?
2. What will be the best way to apply for my dependants visas?
3. Which application form should I use as for the dependants who are not applying at the same time with main applicant?

Early response would be appreciated.

Have you tried contacting them? I would think of asking them a question on the phone first and getting something in writing too to make sure even if you apply, your fees is not a loss to you. Not sure if someone is in a similar position. But overstaying is never recommended. Make sure you post any replies and look out replies from someone with a similar experience.

Try phoning them immediately and find out regarding your ILR application. Also find out the E-mail address to contact them immediately.

Kevin,

My plan was to apply FLR(M) for dependants once I get my ILR but unfortunately thats not the case and I am still waiting. I applied through premium service and never thought that I will be waiting for such a long time. I still had three months left on my visa to expire at the time when I submit my application.

I start my day with a hope that I will get my ILR today in the last two months. It has been a long wait, cant explain anymore..........

Dear gla17,
Not trying to disappoint you but if the decision is not given on same day at PEO it could take its own time I.e. postal application. I think you should act on taking some advise/action about your dependents visa situation...good luck buddy.

I called UKBA today and I have been asked to send SET(O) for the dependant through the post alongwith other supporting documents. I was also asked to include a cover letter explaining the reason why dependant did not apply with the main applicant.

With regards to my own application, an adviser I spoke with, she stated as my application has not been decided on the same day so it will be considered as postal application even though I applied through premium service and they will take their standard to process my application.

I explained my query in detail over the phone. I was asked for the application reference though and then she put me on hold for sometime. After that she advised me to send it through the post which I am planning to do so early next week.

Also, when sending the application, ensure you tag your dependants applications with your own application reference number in the body of your cover letter .

Regarding your application, be positive that the outcome is fine.
