tier 2 sponsor company in Liquidation

Post by monky123 » Mon May 27, 2013 8:05 pm

I am person outside EU, and working for a company for last more than 1 year on tier 2 general, now that company went in liquidation.

I believe, after liquidation company's licence is revoked. is that right?

After liquidation, immediately my sponsor opened a new company with different name and he want me to stay on the same position. What are my options?

Do I need to leave the country immediately?

How much time will be given by ukba for either, leave country or find new sponsor?

Can I continue working for same sponsor (but with new company name) while my sponsor apply for new licence and COS for me? would all this process can be done by staying within uk and working for same company during process?

I really appreciate for any help.

On liquidation the company's licence is revoked and migrants' leaves are curtailed to 60 days from the date the decision to curtail is made. This is to allow migrants time to find a new sponsor.

You can only work for the new company if they obtain a sponsor licence first, assign a CoS to you and you apply for and obtain leave to remain.

as I mentioned my sponsor opened a new company with different name and he want me to stay on the same position. Do he need to run labor market test for new company?

Hi

If your employer has shut down his company without paying all his bills, he may have problems obtaining a sponsor license for the new company he is starting.

May I suggest you seek alternate employment and in the meanwhile ask the employer for a written explanation of the legal basis on which he wants the new company to employ you?

Kind regards
