Tier2 Gen - Affect on sponsorship due to maternity brk

Post by destiny82 » Tue May 28, 2013 9:47 pm

Dear Mods,Gurus and experts,

I am new to this forum and need some urgent advise. Here's my situation -

I am currently on Tier2 Gen visa since Jan 13 and my husband is on Tier2 Gen partner. My next extension is due in Jan '15.
Recently my sponsor has asked me to keep atleast a month's salary reserve so that they can still continue to pay me during off contract period so as to comply with recent changes in HMRC rules.

Now my question is that if i plan a maternity break (approx 6 months) before my next extension,i am a little worried whether my sponsor will still continue to sponsor me during the maternity break? As we have a 75:25 arrangement between us where he gets a 25% cut from my monthly contract invoice.Clearly i will be off-contract during the maternity break so what happens if they revoke my COS on any other reasons (e.g redundancy, reduction in staff etc) as they wont be able to churn out any money from me during my maternity break, add to it as per HMRC rules employer they are also liable to pay SMP during the maternity leave.

In case if he revokes my COS on any false ground what other options are available to me to continue my stay in the UK because as a sponsor he reserves a right to retain/revoke a COS anytime.

I am really very confused and unable to decide on how to plan things ahead.Any valuable advise will be much appreciated.I dont want my maternity break to affect my VISA situation, kindly advise.

Thanks
