Can I apply for ILR now? Need help please

Can I apply for ILR now? Need help please

Hi, my case is different for applyingILR. Please suggest!!
I have got my HSMP VISA in 2008 jan for 2 years. In 2010 I applied for my another 3 years extension, where my application is rejected on the basis of my a bank document they are not happy with. I received my passport in the month of April, I made an appeal and I am succesfull. In October 2010 I received a letter from home office to send my passport and photographs. I received my passport in nov 2010 for 3 years.

From the above case am I eligible for my ILR NOW? I came to know that I am in the country during that period, so I can apply for ILR now. Is that true?
