Wife Applying for ILR - Will she need ESOL & Life in Uk

Wife Applying for ILR - Will she need ESOL & Life in Uk

Hello everyone

My story goes like this. Im a British Citizen and my Wife is still on Spouse VISA which she obtained in June 2011. Its valid for 2 Years. Before that she was on her fathers work permit for 5 years. So in total she has been in Uk for 7 years. The spouse visa Its due to expire on 15 June 2013. When she applied for the spouse VISA she was made to submit Life in the UK test certificate and proof of ESOL.
Now she want to apply for ILR does she need to submit again Life in Uk test and ESOL pass certificates? The thing is The ESOL test certificate is Expiring on June 8 and we are planning to apply on June 13. Does she need to seat for another ESOL or the one we submitted in 2011 will be still valid?

Another question is in the event that she is successful in getting ILR can we apply for naturalization soon after without waiting for 12 months?

She can send Life in the UK test only. She doesnt need them both just now.

So can we include this expired proof of ESOL in the application with a note stating that this has been submitted already in the previous application?

Hi Dear ,

I think you should have to do ESOL again because Caseworker wont accept the Expired Esol while Your Life In UK Test in valid Indefinite.

Nim2013 is incorrect. She only needs the Life in the UK certificate. As the wife of a British Citizen she will qualify for BC immediately after being granted ILR.

This is a relief. We have an appointment on 12 June at sheffield.

The other thing is She has recently changed surname from hers to Mine. Does this matter much in the eyes of UKBA? as long she can prove that she is still the same person?

She can change her name when she wants, just at the time of application she needs to prove the link between the new and old name, or as you said "she is the same person with a new name".
