Applying for Tier 1 visa (PSW) route/50k
Money held in UK

Regarding the point that you have to show that you are engaged in business activity and you must show trading:

Who is supposed to write the business contract and set up its terms and conditions:

Is it me (as a director of my xx limited company), or is it the other company to which I will provide my services? In other words, is it me who has to write the contract and put the cost of the services I will provide,as well as all the terms and conditions, and the other company has to agree on this contract and sign to show confirmation?


Second question, if It is me who has to write the contact and its conditions, is it mandatory to put my company logo to show that the contract is original?

I apologize if my question seems silly, but the more I read the policy guidance the more I got mad.

Please advise...

Well a contract is signed between two parties so both of them should have agreed terms and conditions in contract. Ill take my case and advice you...
I got a contract with a company and provided software development and consultancy services through my company. so the company who required my services already had a detailed contract with terms and conditions. this means usually companies who are taking services from your company will already have those terms and conditions in contract.
If its not the case then you have to draft it and get it signed.
I wont suggest to have a logo coz its not just your agreement , but its an agreement of other party as well.
Details of both the companies is what you must add in the contract.

You are providing services so ofcourse you will setup terms and conditions and whom you providing services too will have to read and sign and that mean both parties agreed ?


I think I have answer your question but do read policy guidance in details with concentration rather than going mad take something from it.

Thanks a lot for your advice.

My case is similar to you as My company provides Electrical and instrumentation engineering services to another company and that company to which I deliver my services gave me a long detailed contract with their logo on top and I confirmed that I agree on the terms and conditions on the declaration page and I signed the contract.

This seems as if the other company has the control and it can terminate the services whenever sees appropriate.

For this reason, I am thinking to provide another contract that is written by me and shows that it is me who has the lead and control bcz I do not trust UKBA and how silly they think.

I appreciate your advice.

Actually the contract that I have signed now is written by the other company to which I provide my services and I signed on it as confirmation of agreement of their terms and conditions..Is there any rule in the policy guidance about who should to write the contract? I cannot find details about this point in policy guidance. It just says that:

You must provide one or more contracts and explains what the contract must show.

the answer is simple. any party can prepare the terms and conditions. Whoever prepares it may have their logo at the top although its not mandatory.

for example: say you are going to an immigration advisor company for some visa services, they ask you to sign their client care letter prior to actual service provision.

in this case no one expects the individual to prepare terms and condition. The terms are therefore prepared by the company itself and will have the company's logo.

M agreed with rsrameshsunil. to my understanding i think company should have the term and condition in place coz as a company we cant ask individuals (customers) to get contract ready for you with their term and condition. its company who should get the clients sing the contract on the basis of term and condition they offer like everyday life we sign different contracts with different company on the basis of their trms and conditions for instance mobile, broad band, insurance even applying for a loan we got to be agreed on their term and conditions.if control is in customers hands and they breech terms and conditions then what the outcome gonna be. (in my opinion)

it doesn't really matter who prepare terms n conditions.

but like you guys mention you sign contract for mobile its term and conditions of the service provider which you sign and than you are abide to follow same for broadband contract etc so basically you are signing term and conditions setup by service provider.

in your case you are service provider and your clients are your audience so figure it out who should prepare terms and conditions???

eg can you go to Vodafone Mobile shop and say I want to buy idiot-phone 5 on 24 months contract and here is my terms and conditions which you have to sign and I will buy the contract on my terms??? ofcourse not

Well I guess you have got all you need in contract so don't worry about who will write terms and conditions in it.
Make sure you have
1) Contact details (ALL) in contract.
2) Name and details of companies and directors with signature.
3) Services provided by your company.
4) Original contract (If possible) else each signed page.
