Entry Clearance refusal for Family visitor

Post by rnarsapuram » Fri May 31, 2013 12:50 pm

I'm on a Tier 1 General visa and recently we have applied for family visitor visa for my mother-in-law.

She has been refused entry clearance because ofthe following reason:

You have indicated in a supporting affidavit that you are married, with a property and savings. However, you have not provided any documents to support this claim. Whilst I accept that this is not an explicit requirement of the Immigration Rules to provide such evidence, full knowledge of your circumstances is an important consideration when assessing your application for a visit visa. In the absence of such evidence you have not satisfied me, on balance of probabilities, that you are genuinely seeking entry as a visitor for the period stated by you. Not have you shown that you intend to leave the UK at the end of the period as stated by you.

They are referring to the following piece in the affidavit that my in-laws have provided:

That I am a Housewife. I have a house property, at <so and so place> jointly purchased along with my husband. I have a joint fixed deposit at state bank of India for Rs. X,00,000

She (the solicitor who prepared the affidavit) has wrongly mentioned about the property on her name, she doesn't have any property on her name, but the fixed deposit is fine.

Can someone please help/suggest me if I can reapply for her visa with correct documentation and mention/admit the mistake, correct the mistake put all genuine documents. I would like to say that they've not provided any false documents.

what is the possibility of she getting a visa on re-applying, as we dont want to appeal.
Best Regards

Yes you can reapply straightaway. This time provide the correct documents and try to address any points which raised doubts in the mind of the ECO.

Reapplying unfortunately does not guarantee that the visa will be issued.
