Refusal of EU1, failure of address proof

Refusal of EU1, failure of address proof

Hi People,

I'm new to the forum, although I have been checking this forum before in the past. We have applied for EU4Fam in November 2012, received the EU4 stamp in December 2012, while waiting 6 months for the Eu4Fam card to arrive. One week ago, we have received the documents from the INIS with the... Refusal for our application... Reason: we did not submit the necessary documents requested:

- letter from landlord/agency
- PRTB registration letter
- Utility bills for applicant and eu citizen

We have submitted our rent agreement, registered in both names and a electric ireland bill with both of our names, we left out the PRTB registration letter, as we did not have it, but we didn't wrote this in a letter.

I'm getting the PRTB registrations done and will sent them with above documents to the INIS with the request of review of our application. What is the time frame for their final decision to be made? Do we have to worry for deportation of my wife? My wife's GNIB card has been expired last week. Anyone with experience who can advise us, please do so, as we are living in an uncertainty with our EU passportholding son.

don't worry mate you not going to get deport for this.just make sure send all the address proff and PRTB letter.when you going to submit your application next time ask them to give your wife temporary stamp while application is on process.i think you have to fill form 4 this time just make sure submit all the documents again with refusal letter. www.inis.gov.ie eu treaty section good luck

Had they mentioned the missing PRTB registration when they sent the Temporary Stamp 4 letter or in another communication before they sent the refusal? In theory, in case of missing documents they have to give you an opurtunity to provide them before turning down your application. If they didn't ... I it might be worth pointing this out to them and asking them to reconsider their decision (while obviously providing the registration to them).

Hi Jeupsy,

I'm asking them for a review of our application, as they accepted our application in November 2012 and sent us the temporary EU 4 card in December 2012, they never mentioned any document missing meanwhile. Is this their reason for giving us a chance for review when submitting the missing original documents?

How jeupsy said, without giving you chance to provide those things ,they cant really refuse you, Send application to review , and in the same time contact Solvit , as they will be very usefull. In my case they were really very usefull.

What are the activities of the EU spouse?

It is interesting to note that the directive does not mention proof of address for the application of residence card.
