Eea extended family member

Dear all
I am an Eea national. My cousin living with me in the UK as my dependent relative.he came to UK as a visitor few years ago. He applied for Eea resident card 9 months but unfortunately Ho refused his application Last week and refusal letter stated that he did not show that he was my dependent relative in third country. So please quick advice . Time is running out for appeal.

Was he dependent on you in the country from which he came, and does he continue to be dependent or member of your household in the UK.

He was not dependent on me in third country but he lived with me for some times in third country. Please quick reply

Did he live in a house owned by you. And were you an EEA national when he lived there.

Yes .when he lived with me in third country that house owned by me and that time I was an Eea national and we lived in same house just a month or so. Please quick reply

He may very well have a strong case at an appeal, provided this can be proven.

I got prove that we lived in same household in third country for a months or so but that time he was not my dependent and that time he was a businessman in third country.I can't show dependency in third country.But I can show the household membership Before he come to the uk.So please tel me how can I face in the court

A person can only qualify as an Extended Family member if they are able to provide evidence of pre entry dependancy or household membership.

Application of this nature can be a bit complex, you may want to seek professional advice on what you currently have, and how you can boost it further, and how you will proceed with the appeal.

Thanks for kind reply. My cousin was my member of household in third country. He came to UK 6 years ago but he is living with me as my dependent and member of my house hold last 2 years. So please tel me how can I proceed?thanks in advance

I am unable to advice how you can produce, if your evidence is satisfactory, and the court is satisfied, you may succeed, otherwise you will fail.
The situation of extended family members is quite complex, and it is difficult to give advice on whether the evidence burden has been discharged on the forum.

Congratulations on your cousin's appeal. I have a similar situation - refused for same reason and was hoping you can advise on how to go about the appeal.

No two cases are similar.

To qualify as an Extended family member, you are required to demonstrate both pre entry and post entry dependancy or membership of the same household.

we showed evidence of dependency in the third country through high school and Uni receipts paid by EEA Sponsor. Also continued dependency in the UK - we living together. The HO refused because '' they noticed that my nephew entered the UK through a student VISA and I did not show a joint tenancy agreement. Should we have a joint tenancy agreement as he is dependent?

They also said they are unsure of his dependency just before arriving into the UK despite show evidence that i paid for his flight.

Any advice will be helpful

It may be best to appeal the decision, in those circumstances.
