Dismissed, when shall I have to leave the UK?

Hi, could anyone help me? I am currently dismissed while I still have less than 6 months before my tier 2 visa expires. Could anyone tell me how long I can stay before I have to leave the country? Thank you very much!

If you have been asked by your company to quit, the company has an obligation to inform UKBA that they'll withdraw your CoS. In this case, UKBA will curtail your leave depending on the date your company has withdrawn your CoS.

The reason for your dismissal and your personal situations matters. For instance, If you have a dependent child under age 18 in UK, if you switched from another immigration category to TIER 2, the UKBA may show some discretion in curtailing your leave.

Thank you VickyImmy. I was transferred from Tier 4 Dependent to Tier 2 and I don't have any dependent under my Tier 2 visa. In this case, how long can I stay in the UK?

Well, This does not have an easy answer. Because, curtailment is something that is dealt on a case by case basis by UKBA.

You should ask your company when they will withdraw ur CoS. Usually UKBA gives upto 60 days from the curtailment date to leave the country. However, they can execute discretion based on many reasons.

You may expect the following to happen. For those who applied within UK for TIER 2, if your employment is terminated you must return your passport and BRP to UKBA so that they will curtail your leave. For those who applied outside UK UKBA will request these documents from you.

Either way, UKBA will have to be advised by your company. So if you know the date your sponsorship is terminated you can contact UKBA then.

in case of curtailment and in the absence of special considerations if your current leave was granted before 23 May 2011 UKBA will write to you requesting your passport and BRP.
