Unusual Tier1-ILR Situation

Hello All,

I am stuck in a very unusual situation and don’t know what to do or whom to contact.
My situation in a nutshell is as follows:

I Lived in Dublin, Republic of Ireland and worked for 1 year from June 2008 to July 2009 (Irish work permit valid till May 2011).

I Applied for Tier 1 General from Dublin. Tier 1 Visa valid from August 2009 to August 2012

During August 2009 to February 2010 I was travelling between Belfast (UK) and Dublin (Republic of Ireland) for job interviews. I travelled to London once for a job interview.

As you may know there is no Border Control or Immigration Check between Northern Ireland (UK) and Republic of Ireland, hence I do not have any immigration stamps on my passport (first Date of Entry into the UK)

I went outside UK for 1 month and came back on 28th June 2010. This is the date official date in my passport as my first entry into the UK. However I already entered Northern Ireland (UK) in August 2009 for job interviews (but I don’t have any official stamp on my passport)

I know it is too early to ask but I’m worried about below questions:
1. I am due for my second extension next year 2014. This time should I go for ILR or is it another Tier1 extension?
2. How can I prove that I first came to UK in August 2009?
3. Initial 90 day exemption doesn’t apply to me right?


Apologies for a long story. I tried my best to explain my situation but if you have any queries please ask me.

Collect any information that you have to prove that you travelled between the two places on these dates (vouchers, receipts, passes etc). Keep this as proof of travel into and out of the UK.

Unfortunately I do not have any receipts as I disposed them at that time (in 2009). I had no clue that I will need them now.

However I have an email invite from RBS dated 24-NOV-2009. But this is outside the 90 day period. (first Tier1 in 9th August 2009)

Please advice.
Any suggestions are most welcome.

Sorry to hear about your plight, Bobby.

If you did pay by card, at any point during your visit, your bank statement will reflect that.

Alternatively, it may sound a little far-fetched, but if during that visit, you did send out emails, your IP address can be used as evidence of your location as well.

Hope you'll find a solution soon.
