Pakistani spouse of Polish citizen moving to Ireland

Post by Azoo_humble » Wed Jun 05, 2013 8:31 pm

Hi,

I'm a Pakistani National with a residence card of Poland and married to a Polish national. What are my rights to residence and work in Ireland. I will be accompanied by my wife to Ireland.

I will be very thankful for your prompt reply.

Ireland has to issue you a short term visa to go to Ireland with your EU spouse. Once you are in Ireland she must be exercising EU Treaty Rights within 3 months for you to be eligible for a residence card (this means she must become employed, become self-employed, or become a student in Ireland). If she can meet one of these 3 conditions it will be fairly easy and straight forward for you to obtain a residence card which allows you to work here.

If she can't meet these conditions, the options are quite limited (you guys would need to prove you are self-sufficient, but this is a tricky notion to define).

Here is the link for this type of residence permit: http://www.inis.gov.ie/en/INIS/Pages/EU ... y%20Rights

You can also search this forum for "EU Treaty Rights" or "Stamp 4 EUFam" for more information.

Thanks for your reply jeupsy.

Can you kindly tell me what rules will apply to me if I only intend to visit Ireland with/ without my wife. Thanks.

If you only intend to come for a short stay and are accompanied by your spouse, then it is pretty easy. You just need to provide both passports and your marriage certificate along with a proof they you will be traveling together; and the Irish embassy has to issue you a visa free of charge. Under EU law, as the spouse of an EU citizen they are not allowed to ask you for more documents (such as bank statements or proof of travel insurance).
