Hi, I am writing, because I might have a problem with my husband’s visa. Now after 2,5 years we are separating and I intend to move out, but don't want to cause him problems later. So, here is what our situation is like:
- I am Latvian, EU national, moved to London Sept 2007.
- My husband is Uzbek, Non - EU national, moved to London March 2007.
- We got married in Oct 2010. He was on a student visa before. Then after marriage got visa - first for a year, and after for 5 years a residence card of a family member of an EEA national, with employment and business activities allowed (valid from Apr 2012 till Apr 2017).
- We are officially living in one address since Oct 2010 - have all bank statements, utility bills, council tax, both have NI, paying all taxes.
- He has the same job for 5 years, full time, earns under 23.000 per annum
- Me - being out of job twice within these three years for three months every time. First May 2011 - July 2011 without claiming benefits, then June 2012 - Sept 2012 getting contribution based JSA. Then in Sept 2012 I started university, I got paid tuition fees, maintenance loan and grant.
And here are my questions:
1 Should he apply for ILR and when can he do it?
2 Will of the financial supports I received - contribution based JSA, university tuition fees, maintenance loan and grant - affect his application?
3 Will the fact that I was out of a job for more than a month affects his application?
4 Will an official acknowledgment of our separation before three years period affect his application?
5 What would be the best thing to do in our case?
I would appreciate any help with any of these questions. Maybe someone has a similar situation and can share their experience.
