UK wife, US husband, coming from another EEA country - help!

Post by rainbowfire » Fri Jun 07, 2013 11:30 am

Hello everyone.

I've just joined these boards, and would be very grateful if anybody could help us out here. I'll try to explain simply:

I am British, and in 2 weeks I'm marrying my fiancé, who is from the USA. For the last two years, we have both been working and living in the Czech Republic. A few days after the wedding, the plan is to go to the UK, stay with my parents for 10 days, then head to Thailand for our honeymoon. Our honeymoon is going to last 7 weeks!

After that, we're coming to the UK, and hoping that my husband can stay with me based on the EEA family permit. We know that I count as an EEA citizen (even if that EEA country is the UK itself), and that the fact we're married and have been living/working in the Czech Republic should mean that he's able to live and work in the UK with me.

The question is, when is best to apply? We can't really apply now, because we're not married yet, and the marriage certificate likely won't be ready until we're back in the UK, if not later. Can we apply from outside the EEA zone - e.g. from a British embassy in Bangkok? Or can we apply at the airport when we arrive back from the honeymoon... or from inside the UK? I'm worried that the honeymoon will make things more difficult for us, as well as the fact that I'll need to change my surname after the wedding, although I'm not going to start doing that until after the honeymoon (as my passport will still have my maiden name).

How hard is this going to be, and what will we need? The Home Office website just sends me round in circles and confuses me... it says we can apply online, but I don't see a link to that option!

Thank you!! :)

I assume richomondo is your fiancé?

I suggest you read his thread as it would answer most of your questions.

I don't see much point applying for a EEA Family Permit through a British consulate (as you won't have your marriage certificate). If you would have the certificate by the time you travel back from your honeymoon, he can seek admittance at the airport (you will need to carry all the documents with you).

Probably most practical way would be for him to enter as a tourist (just for short visit) and once you have the required documents apply for a 5 years Residence Card using form EEA2 from within the UK.
