Hi
I applied for Tier 1 Entrepreneur visa on 8th of April and I received the refusal letter today. The reason they refused was as follow
You have claimed points on the basis that you are currently a director of "abc Company(name changed)"
you are required to submit evidence that the business has a business premises in the united kingdom: A printout of a company house document showing the address of the registered office in the Uk, or head office in the UK if it has no registered office, and your name, as it appears on your application form, as a director.
You have not submitted a current companies house report.
you have therefore not submitted the specified evidence as listed under paragraph 41-SD to establish that you have access to the funds that you are claiming.
Ok thats the main bit of their reason for refusal. They have given me the right to appeal against this decision. But they have also made a decision to remove me from UK therefore they have retained my documents.
Now my question is why did they ask for company documents when I clearly mentioned in my application form that I was applying as a Sole Trader not as a limited company. I applied under SOC code-2421 and my role was company accountant. My job is to maintain accounts of other companies as well as sole traders and self employed. And what is that about removal notice? Is that something serious? If I appeal against this and show them that I did provide all the documents of me being registered as self employed with HMRC will I have any chance of winning the appeal? Although there is one thing about the registration, I had registered for self employment 6 months before my application. But I started this business that I applied for a month before application. As I was not a company I did not have to register the business with any authority. How can I prove that my business started within 3 months prior to the application. Any other suggestions regarding this will be appreciated.
Just a bit of information about my study background. I was on PSW while applying for tier 1. I have a bachelors degree in Applied accounting. So is my role as a company accountant appropriate under the SOC-2421. my solicitor said its fine. Please advice me on the topic as I want to submit my appeal as soon as possible.

A well prepared and planned appeal will definitely get you across the line. like you said if you can prove it point than nothing to worry about and regarding keeping your passport etc its normal practice for anyone who get there visa refused and last leave to remain is expired as it making there life abit easy to get rid of person if decided not to appeal.

So sorry to hear about your refusal. Passport retaining is a standard practice when your leave to remain expires. All hope is not lost as you were given the right of appeal. you need to present your case before the tribunal. They are really out to frustrate a lot of people.
