FLR(M) or Tier1 Dependent visa

Post by oursnetuse » Fri Jun 07, 2013 9:34 pm

Hello,

currently I am on Tirer 1 general and I finished 5 years and in month time I will be applying ILR.

Currently my wife is on Tier 1 Dependent visa and she is in UK about 10 months only so after my ILR, she will be applying for FLR(M). SO I just like to know how many years of validity she will get with FLR(M) visa? Also does she need Life in UK test?

There is another option, I can also apply Tier 1 dependent visa but I do not know some how I preferred to apply FLR(M).

Guys, do you have any thoughts on both these options? Which one is better? I sure many people must have come across same situation so please help in finding this.

Thanks for your help.

If she was a PBS dependent prior to July 2012 under the old rules, I am assuming so, she can extend her PBS dep visa under she has qualified for settlement (2 years as PBS dep).

Thanks Guru.

She is on before july rules and she can apply for PBS dependent.

I would say just extend the PBS dep, though if she applies for flr(m) she should be able to use the time on PBS dep towards the 2 years period required to apply for set(m).

I agree guru...but like to know more about FLR(M) too. What it makes difference if she go through FLR(M) route?

I think it just easier to continue on the pbs dep plus some caseworkers seem to be mistakenly rejecting set(m) applications where the 2 year period includes a pbs dep visa.

Though, for example, if the spouse had settled due to long residence (10 years) then the pbs dep would need to change to flr(m) and then, once they have satisfied the 2 year period set(m).
