Hi Everyone,
I am already 5 years in the UK and I wish to apply my PR (EEA 3 application). I am EEA National so i need to meet 5 years treaty right. Everything would be perfect if not one thing which worries me a lot.
During my employment I went on maternity leave (still employed by Pizza Hut). I was on Maternity Allowance which means my maternity was paid by JobCentre as my income was too low to be paid by company. I have only letter conforming I was their employee.
Will it affect on my Treaty Rights?

Have you been employed throughout the 5 year period? Maternity leave will not be considered as a seizure of exercising treaty rights.

Since an employed/self employed person pay NI contribution therefore, they are legally entitled to maternity allowance which are NI contribution based and should not cause problem. You can go ahead with EEA3 if you worked 5 years. You can attach your employer letter confirming that length of employment and if you have P60s you can also attach to support it.

Thank both of you for quick responses.
I was employed for 4 years. During my employment I went for maternity leave and did not go back to the same work so on the end they gave me employment letter and P60 which shows only £150 as I was receiving Maternity Allowance from JobCentre. In meantime I was also student.
My last year of Treaty rights is self-employment. Is it mean my Treaty Rights are all right?
I am not sure if I should send my P60 with application as it shows less earnings. I hope I am qualifying for PR.

There is no earning limit in EU route applications. Your 5th year's self employment is also another mode of exercising treaty rights.

So do you think my application should be all right even if I was on maternity and paid by JobCentre?
A few more question:
1 - I was as well student in the meantime so do I need comprehensive health insurance?
2 - Can housing benefit and tax credit effect my application?
3 - Whats about first 2 months in the UK as I was without work?

Answers:
1. Yes
2. EEA workers/self employed persons can claim benefits and caseworker will look on each individual circumstances
3. 1st three months an EEA national is exempt from any treaty rights since entered.

One final question: are you sure there is need comprehensive health insurance for period I was student even if I was employed? I thought it is no need if I registered my WRS as a worker and student.
Now I am worried very much as I do not have comprehensive health insurance
. Without this will Home Office refuse my application?

In that case you just stick to being worker which does not need CSI-private medical insurance. WRS scheme was for A8 nation workers to complete their first 12 months between 2004-2011.
