Urgent advice EEA2 holder and EEA national treaty rights

Post by londonman » Sun Jun 09, 2013 7:25 pm

Hi,

I've posted this before but now my situation is different. It would be nice if somebody could help me! I am Residence card holder and I am gonna make a quick trip (2 weeks) to Mexico next week and I would be arriving to Bristol airport on my way back to the UK.

This is my situation:

-Jan 2011 Removed from UK at Heathrow airport.
-Feb 2011 Got Married with EEA national
-Jul 2011 Got my FP to come to UK
-Sep 2011 Entered the UK
-March 2013 Got my RC

I have some doubts about my travel because:
I've been outside the country for holidays just twice and both of them travelling with my wife (one was when I was holding my FP and the last one my RC was in process but as my wife and I were working we were allowed to enter the country) and every time I've been stopped at the border as the system shows them that I've been removed in 2011 before getting married.

Anyway, I got my RC in March. She is still under a contract with some job but not working now there. She decided to start to study a 3 months course at some uni which is done now. She has been interviewed to get a job last week but no success.

I want to go next week to Mexico but I am scared to be refused as we don't have private medical insurance and my wife doesn't have a job. At the same time is under that contract with that school (but not working) and also I will be in the system at the moment I show my passport to the UKBA officer.

Any advice??
Does she qualify as job seeker? Self sufficient?
As her mom helps her with money and also I am a full time worker.

Thanks a lot!

If EU national is a worker, student or self-sufficient person as defined, then you will be fine.

As long as they are exercising treaty rights properly you have no danger.
