Tier 2 G visa curtailing

Post by chetanmahendroo » Mon Jun 10, 2013 9:04 pm

Hi,

I am currently on a Tier 2 G visa, valid till Oct 2015.

I have resigned from my job 24 May and my ex-employer informed UKBA on 9 June. I assume i have got 28+60 days as a grace period to stay here and find a new sponsor.

My questions:

1. My grace period starts from 24 May or 9 June?

2. If i find a sponsor and local market test is also completed, how much time it would take for my new employer to get the CoS from UKBA?

3. And how much time it would take UKBA to give me new VISA stamp once i file the application (after the CoS is issued)?

Thanks in advance !!!

1.
refer to this document, especially page 32 about what you need to do:
http://www.ukba.homeoffice.gov.uk/sitec ... iew=Binary
the 60 day period will start from the date UKBA make the decision to curtail. It is not possible to predict when that will be but it is reasonable to assume that it will be at least 28 days from the time your previous sponsor reports your termination.
2
Provided the new sponsor has a) a sponsor licence and b) an allocation of unrestricted CoSs for the current year the assigning of a CoS is only a matter of minutes.
3
depends on how you submit your application, e.g. premium service, priority postal or ordinary postal.

Thanks, that was very helpful.

Just one another small question:

1. If my new sponsor applies CoS for me, before UKBA decides to curtail (i.e. before the 28 days), will it create any trouble?

Thanks !

Hi,

A doubt:

When i apply for Visa stamp after the CoS is in place,

1. My visa duration remains the same i.e. 3 years?

2. Or UKBA has the discretion to change?

Thanks
Chetan

Hi,

Sorry, i have come up with another question:

My wife is on dependent visa here in UK. When i get a new stamp for new CoS, does she also need to get a new stamp or she does not need it?

Her visa does not have any mention of CoS, it just refers my name as the main applicant.

Thanks
Chetan

if your leave is curtailed so will your wife's and she must re-apply. The fee is a little less if she applies at the same time as you.
