Hi! I have a tough situation - want to get a divorce or separate, but don't want to cause troubles to my husband.

- I am Latvian, EU national, moved to London Sept 2007.
- My husband is Uzbek, Non - EU national, moved to London March 2007.
- We got married on the 10th Oct 2010. He was on a student visa before. Then after marriage got visa - first for a year, and after for 5 years a residence card of a family member of an EEA national, with employment and business activities allowed (valid from Apr 2012 till Apr 2017).
- We are officially living in one address since Oct 2010 - have all bank statements, utility bills, council tax, both have NI, paying all taxes.
- He has the same job for 5 years, full time, earns under 23.000 per annum
- Me - being out of job twice within these three years for three months every time. First May 2011 - July 2011 without claiming benefits, then June 2012 - Sept 2012 getting contribution based JSA. Then in Sept 2012 I started university, I got paid tuition fees, maintenance loan and grant.

Now after 2,5 years we are separating and I intend to move out, but don't want to cause him to problems with his visa, so I have couple of questions:

1. Should he apply for ILR and when can he do it?
2. Will of the financial supports I received - contribution based JSA, university tuition fees, maintenance loan and grant - affect his application?
3. Will the fact that I was out of a job for more than a month affects his application?
4. Will an official acknowledgment of our separation before three years period affect his application?
5. What would be the best thing to do in our case?

I believe there is somebody who had exactly the same situation and could help me with an advice or share with their experience! Thanks! :D
