Refusal Received - Expert advice needed

Hi,

I have received a refusal with a right to appeal; lost all faith in my lawyer. Tried to call other lawyers but looks like nobody calls you a call back.

I have nowhere to go and have invested into the business, a few questions:

1) Can I file for an oral appeal by myself?
2) What documents do I need to file an appeal.
3) Do I need to fill Section D, if I am appealing for an Oral appeal.

Thank you all for your replies. The reasons are as follows:

1) You showed less funds than before - the reason I invested that money in the business, I have proofs

2) No Current Appointment report - can produce one

3) NQF level 4 below application, have proof that showed NQF level 6 occupation in business plan in interview.

Please reply urgently since few business days left to appeal.

Which Soc Code you used for Statistician and please if you can share your timeline like application date interview date etc. thanks

I applied on 15th Dec 2012, Interview 16th May 2013 and rejection sent on 3rd June 2013.

Can somebody pls HELP ME! I have very less days to appeal.

can you explain these two points raised against you?

did you not have the full 50k in your account or did you claim in the interview that you had invested part of the money?

did you submit the current appointment report with your application?

- in fact I had more money since due to exchange rate fluctuation. For the part I had invested - I submitted the recipts.

did you submit the current appointment report with your application?
- I did not submit the report since my lawyer did not tell me to. But I can easily get it, since my company is genuinely registered.

Regarding ur refusal start preparing ur appeal under evidence flexibility.

Regarding investment u need unaudited account / certificate from accountant not receipts which u submitted.

Regarding soc code n nqf level 4 above if ur services matches job title etc and u think u can defend it than all problem sorted.

did you submit unaudited accounts as well as an accountant's certificate with your application to support the fact that you had already invested part of the money?

the current appointment's report is really important. that is about the only documentation that UKBA can use to confirm that you are a still a director of your company as at the time you applied.

its a tough call. i will suggest you get a good lawyer to help you out.

the appeal entails two things
1)completing the appeal form and explaining in detail your grounds of appeal
2)defending and explaining yourself in court

are you competent enough to do both yourself ???

i am personally not a fan of using solictors. Especially for initial applications. However, for appeals , especially in such complex cartegories like the entreprenur route, you are almost better off employing the services of a very competent lawyer.
