Sponsor Elderly dependent visa

Post by Nazz » Thu Jun 13, 2013 1:15 am

Hi
My mother arrived in 2009 as an elderly dependent and was issued with an
Indefinite Leave to Enter, as being her sponsor, I was informed that i have to provide her accommodation without recourse to public funds for at least five years, which I did.
My financial circumstances have changed now, and my question is, can I apply benefits for mother ?

Not if you signed a five year undertaking. Once the undertaking ends you can. A breach of a sponsorship (unless allowed for example, the sponsor dies) can result in prosecution.

However, if your Mother is disabled and has care needs she could possible apply for benefits, though I need further information. Which country is she from and is she disabled?

She may be deaf but that doesn't mean she has care needs. How old is she and what Country is she from?

Yes as there could be a reciprocal agreement. She has ILE and an undertaking.

Since I am her sponsor then I will have to carry on taking care of her
Even if my financial circumstances have changed.

Well considering you are reluctant to state her Country of Origin and age

I assume she is 65+ and from Pakistan, India or an Arab Country if she has care needs she may be able to claim Attendance Allowance see http://www.adviceguide.org.uk/wales/ben ... _allowance

You're welcome, the good thing about attendance allowance is it's non taxable and not means tested. If she has arthritis and struggles to look after herself for example, then make a claim and get a drs letter to support her claim. You can appeal a decision too and have 1 month to do so.
