Student Visa Curtailment and Spouse Visa Application

Hi

I have been a student in the UK for the past two years. About two weeks ago my college closed down and my leave was curtailed to 60 days.

I recently got married and had been planning to make my application for a spouse visa once the six month financial requirement had been met. The six month requirement will be met within the 60 days period that ukba has given me.

Now the question is am I allowed to apply for a switch in status like this during this 60 days or do I have to reapply for a student visa? I have been told that this may come under section 3c which means that I would not be able to change status from tier 4 student.

What is correct and are my options?

You will apply for a student visa if you are going to be a student. Student is someone who studies. Someone who does not study is not a student and hence can't apply for a student visa.

If you want to apply for flr(m) before your current leave expires, then you can do so.
