If you dispute the penalty you should appeal if you have no tax liability then you can't be evading paying tax and thus should have no affect.quries77 wrote:Dear Amber,
Thanks for your reply, I have read Q22 again, in my case I have no income from my Limited company as Director, so I dont have to pay tax on self assessment scheme as I am employee of other company and pay tax on PAYE on monthly Payslip.
HMRC issued me penalty notice because I have not filed yearly return although I dont owe HMRC anything, my query is following,
"Is my British Citizenship get affected if i have receive the Penalty notice from HMRC? and do I have to mention this penalty notice in BC application?"

You can declare it, the fact that you're appealing should be mentioned and that should allow a decision to be made, I see no reason why it wouldn't be a favourable one.quries77 wrote:Dear Amber,

Also once I appeal to HMRC the result or outcome of that appeal will not come because by that time I have to apply for BC, please advise how I should do the application then.

If you are director of a company, or you are self employed, or if you are required to file self assessment for any other reason, then you must file the self-assessment by a certain deadline. If you do not file by a certain deadline, you must pay the penalty. You draw any salary or not, or company makes a profit or not is immaterial. You must file self assessment, even if it shows everything as zero.quries77 wrote:Dear All,
