Previous earnings from own limited company for ILR SET(O)

Post by vishwajitgohil » Fri Jun 14, 2013 3:59 pm

Hello immigration gurus,

I am currently on Tier1 General visa in the UK and am preparing to apply for ILR next week. I currently work as an IT consultant through my own limited company where myself and my wife are directors. Therefore, my earnings include my salary and dividends from the company. I assume this is employed status and not self-employed.

Now, I am getting confused as to what documents to use as proof of previous earnings for salary. My accountant provides me salary slips on plain paper and therefore I need to get those signed and stamped by my employer. But since I am myself the employer and employee both, I don't think I can myself sign and stamp the salary slips. When I called the Border Agency help line and explained this situation, they confused me all the more and could not give a confirmatory answer as to how should I deal with this.

The Immigration Directorate Instructions for Tier1 Settlement Chapter 6A mentions that a letter from accountant to state salary and dividend income can only be used by self-employed applicants. And therefore I cannot use that because if I present myself as self-employed, then I also need to give proof of paying Class 2 NI Contributions and that I am registered as self-employed - which I am not.

If any of you has been through similar situation, please do guide me how should I deal with this.

Thanks,
Vish Gohil.
