Enhanced CRB

Post by $uperman » Fri Jun 14, 2013 5:02 pm

I would appreciate any suggestions.

I had some arguments with my wife , i pushed the door and its main lock broke down , she called the police and i was arrested and kept in police custody over the night. Next morning they released me without any charges , not even was given a caution as they spoke to my wife and she was ok as long as I was willing to repair the lock , I was released giving me a letter stating no action has been taken not even was given a caution etc. i was told i don't have to disclose it anywhere.

They took my DNA and finger prints , I don't know why they took as no action was taken??

My question is does anything would appear on my enhanced CRB???

Are you asking for the purpose of naturalisation or just in general?

Well an enhanced crb check done using the DBS may show up you arrest at the discretion of the Chief Police Officer should s(he) he deem it relevant to the job application. For naturalisation the HO do not use the DBS then run straight from the PNC. Given the circumstances it should have no bearing on your naturalisation application.

Thanks for the info

Even though I was not charged for anything but at the time I was arrested they took my DNA and biometrics , do they take everyone who is arrested even though not charged for anything,?

Also , in my situation do they send info to PNC despite I was not even given a caution etc as they told me?? , the only thing I was told to do to repair the lock and matter is over..

Biometric data is taken from everyone who is arrested. However, under the new Protection of Freedoms Act the data will be deleted, eventually.

It will be on the PNC but should not pose an issue for you.

Thanks for the great info

"under the new Protection of Freedoms Act the data will be deleted, eventually" any idea how long PNC would keep data in my situation and then deleted eventually??

I heard one can request them to remove the data if they are holding it for no reason?

Any data on PNC regarding you will be kept until your 100th birthday. Dont' worry though about 40 percent of people in UK are on PNC, in one way or another.

Your Biometric data should be erased immediately once the Commissioner starts the process as your were 'innocent' (expected around November 2013). The actual arrest information on the PNC at the moment is not deleted. However, hopefully this will change within the next 24 months.

Thanks for reply

I admitted I did break the door but i didn't do deliberately however I was willing to apologise her and repair the door... Does is still mean I am innocent??I spoke to the Sargent and he said there is no caution and nothing like that and I should mend the door and mater is over

My Solistors told me its better to admit and they would give you a warning maximum and release me otherwise if went to the court it could go against me , I decided not to get involved with the court proceeding so I admitted The damage but willing to do apologise to her and mend the door , they accepted and release me and didn't even give me a caution etc

You are innocent until you are prosecuted in a court of law and found guilty of an offence.

In short, just forget about it and take a chill pill.
