Query on annual holidays for Tier 1+HSMP applying for ILR

Query on annual holidays for Tier 1+HSMP applying for ILR

hsmp visa was granted valid from 15/08/2008. my wife(dependant visa) and i arrived on 16/08/2008 - the next day. both my wife and i have indian passports.

after 2 years renewal happened and i got Tier 1 general in july, 2010 valid till 15/08/2013.

I have no work related travel to worry about in the last 5 years. However, there were short personal travels and year wise breakdown is as following:

2013 – 3 weeks
2012 – 1 week
2010 – 1 week
2009 – 2 weeks

The above were either for going home to visit family or on holidays and you can see these were very short breaks indeed.

1 : Do I list the absences above on form SET(O)?

2: if answer to above is yes, what do i give as proof of travel? I was planning to mention these were short personal travels and proofs are stamps on passport. Is that enough? At the most i can try and enclose salary slips of the months in which travelling was done.

One more query please :

For a moment, lets assume instead of applying for ILR, I apply for Tier 1 extension (I meet the criteria). Will i HAVE TO include my UK born baby who is 2 weeks old right now on the Tier 1 application?
OR
Can I apply for Tier 1 extension for mrs and myself and apply Tier 1 for the baby in may be 2-3 months.

You can apply for Tier-1 even if you qualify for ILR there is no restriction provided you qualify on points.... But the only drawback is you will end up paying twice your VISA fees.... With the current visa fees structure all would prefer to pay once with some exceptions.....

If baby born in UK, he/she need VISA(Tier-1 or ILR in your case) if any plans of travelling abroad. If no travel plans, then baby will be eligible for british citizenship once after parents get settlement(ILR) VISA. Hope this helps....
