Singh/Eindt Route Brit plus non eea family Housing Ben

I was interviewed by my local authority for housing assistance last week they accepted me as having passed the habitual residency test but said they would need to seek further advice re if they only needed to count me ,as a single person,or had to include my wife and her child members of my family

We all arrived with out a family permit and were allowed in on the basisof me as a brit having exersized my treaty rights self employed and they both have a 5 year residence card as family members in europe

Here they were given a 6 month stamp at port however I am operating on there being no requirement to apply for eea2 any thoughts on how they should be treated percieved given their right derives from me ?

I read every day but cant post from my mobile

You do not need to obtain documents confirming your right of residence in the UK if you are a family member of an EEA national but it makes it easier to prove your right to PR etc...

If you have the right to reside you are entitled to public funds and to my knowledge there is no rule that the EEA family member must be exercising treaty rights when in the UK under Singh.

there is infact case law that states that you have no obligation to be employed upon return.

your wife is habitually resident... and therefore your claim is for ALL THREE members of your family (you, wife and child - regardless of if the child is yours, or your the step father etc... the child is your family member.
