It was our hearing date yesterday

Post by kandycity » Tue Jun 18, 2013 3:30 pm

:) Hi guys,

As a memeber of this forum I would like to share my experiance with you guys thinking it might help you. Our hearing was yesterday(50k team) and all went without any problem. It took about 40 minutes but I was asked only 1 question by home office rep. Most of the time taken by my solicitor to argue and explain about some unfair rules to the judge and it was seen that the judge was happy about it. We going to receive the decision within 2 weeks time. So do not get worried if you have to go for court hearing. With a good solicitor, you have more chance to win than paper appeal. Let me know if you need more info. Thanks

2 Reasons were not providing a trading contract and one of the team member's job title below the required level(SVQ 3). For the problem with job titile, our solicitor explained that it was a mistake made by our previous solicitor and his original job titile can be matched with 2 titiles from the code which are above the required level. Showed some past documents(Details about previous jobs) to prove that. For trading contracts, our solicitor argued that it is unfair to ask such a document when the business just started and need some time to get clients. We then submited a new contract. Home office rep's question was very strange for me when he said we haven't submitted any documents with the application. I replied him that we have submitted plenty of documents. Then our solicitor made objection to his question and started her long explanation with some controversial immigration cases from history and argued that it is very unfair to refuse our applications base on those reasons without contacting the applicants and asking about the missing or errored documents first, when we had met all major requirements .
Application submitted Sep' 12
Refused in mid of Mar' 13
Appeal made end of Mar' 13
Hearing date 17th June
