Arriving in France

Post by Graham Weifang » Tue Jun 18, 2013 5:07 pm

Hello all,

My Chinese wife was issued a Spouse Schengen visa from the German embassy in Beijing.
Quite a painless procedure, with the correct supporting documents.
The visa says --
FAMILIENANGEHORIGE EINES
UNIONBURGERS / EWR-BURGERS

We departed Beijing 17th June, no issues at all, her passport just stamped as normal.
We arrived Paris CDG 18th June, her passport entry stamped just as normal.
We both went into the "Non-EU" passport lane.
We both walked up to the booth together, and I passed both our passports together to the official.
He didn't utter a word, looked the visa, looked at us, and stamped hers.
All a very easy, non-stress entry.
We will be here for a couple of days, then off up to northern Germany.

A good friend, will employ me for the duration needed to for-fill the SS requirements, by my exercising my economic treaty right.
We will rent an apartment locally also.
Then registration at the Rathaus and application for residence cards.
After a period of my working we will apply for her EEA family Permit, for her to join me under EC Law.

What is the code 1A stamp, would it be applicable in our SS plan UK entry?

yes it would..as long as u have the necessary paper work proving exercising your treaty rights as a worker or self employed and residency proofs, like tenancy agreement, residence card, utility bills on both names and that's it.

Remember that the work in France has to be real and effective.

read http://eumovement.wordpress.com/2011/12 ... -a-worker/

Be sure to keep extensive documentation about your work and time in France. e.g. registering with the city hall, registering with the tax people, paying taxes (if required), enquiries about pension implications of your work, etc...

It may also be that you find it nice to stay and work in France for longer.

Note that you can enter the UK on the basis of MRAX without a visa, but you may find it easier and clearer to first get an EEA Family Permit before travelling. This will also allow your wife to work immediately on entry to the UK.

Note that OP is planning to exercise treaty rights in Germany, not in France. This does not really affect any of your recommendations, of course, and I fully agree with them.
