Confused about tier 2 ict switch

Post by relax21 » Tue Jun 18, 2013 7:00 pm

In UKBA site it is written that a person can switch from tier 2 ICT to tier 2 general if

"Tier 2 (Intra company transfer: established staff), if you are applying to switch sponsor"

NO mention of any date here.

You can check it here- http://www.ukba.homeoffice.gov.uk/visas ... /applying/

4th point under more information.

Does that mean if I have tier 2 ICT established stuff visa, I can switch to tier 2 general? Provided I am switching my sponsor?

Hi,
I have been trying to get an answer to this question but this the first post which says I can switch from Tier2 ICT Established Staff to Tier 2 General.

I will share the answer which I have got. If you have a look at the Tier 2 Policy Guidance on the right hand side of the link given.
Just check page 4 and 5. In page 5, at the bottom of the box, the first note in small font explains what you are looking for!

That is why you cant SWITCH to TIER 2 (General). However, you can apply for TIER 2 (General) as a fresh applicant from your home country.

But it will help if you check if someone has changed from Tier2 ICT to Tier 2 General for visa issued after April 2011.

According to me it can be done but please check with someone who has done it

Note 1 on p5 refers to migrants whose entry clearance was obtained after 6 April 2011.

Tier 2 ICT Established Staff applied for entry clearance between 6 April 2010 and 5 April 2011 and are allowed to switch to Tier 2 General

Even if I go back to home country they introduced a 12 months cooling period for tier 2 ict to tier 2 general application. So, the door to UK is officially closed to any non eu person. Except for millionaires of course, as they can still apply as tier 1 entrepreneur for pound 200,000

It is only if you go back to your home country and apply for entry clearance from there that you will be subject to the 12 month cooling-off period.

There is no cooling-off if you switch from T2 ICT Established Staff to T2G from within the UK

Hi manci,

So you mean to say if I come to UK on Tier 2 ICT say in the month of July 2013. I can switch to Tier 2General within UK?

Do you know someone who has done it?

Also as per my understanding people who are on long term established staff can switch from Tier 2 ICT to Tier General.

People who are Tier ICT Short Term Staff cannot switch to Tier 2 General.

only those on T2 ICT who applied for their entry clearance before 6 April 2011 can switch to T2 General in-country when they change sponsor.
