Help and Support needed.. UK BA crossed all their limits!

On 3rd may they rejected my visa on some stupid reason (contract wasn't signed by my recruitment agency). but the contract was written in a way that they didn't not have to sign it and the time sheet attached with the contract was signed which confirms the legitimacy of the contract. I got all the proofs to fight my case.

Basically they didnt check the papers properly and didnt ask for any clarification.

I filed the appeal on 13th (that was the latest date, on time.)

Money for appeal deducted on 5rd of June and on 6th of June my lawyer got a call saying that their system wasn't showing the details of my appeal. It was a call from CAPITA.

My lawyer explained to them that the appeal has been launched and money was deducted on 5th of June. Confirmation from Royal Mail that special delivery package was delivered on 14th confirms that as well.
He said we are going to send you a strong letter but will mention that in it and will try to regularise your stay.


Technically till the time your appeal is not finished your right to remain in the UK remains legal and your visa status is the same as your last visa.

And then on 7th they wrote a letter which i received today saying “ On 06/06/2013 you indicated your refusal to depart the UK and that you were taking actions to avoid departing. Your right to remain in the UK has expired and you have not taken any action to regularise your stay or provide evidence of your right to reside. This mean that the UK Border Agency intend to remove you from UK and now will begin enforcement proceeding against you”.

This is totally unacceptable , I have spent most important years in my life in this country, paying taxes , NI, working for the benefit of the economy, paid enormous amount of money in good universities as an international student.

Where did I go wrong! If government wants to remove doddgy immigrants then why are they targeting us ? Just because we are easy to target !!

UK BA expects us to invest the money in the business without any guarantee that we will be given the visa or expect us to sit on it for a 7-8 months do nothing with it and then reject the visa.

I call all of you for your advice. Is it possible to write a complain against UK BA or write a letter MP.

Really sorry to hear about your refusal.

You have done a right thing by appealing against the decision.

And you have the proof that you have made the appeal so legally you can stay in this country till the time the final decision is made by the court.

And yes, you have full rights to make a complaint against UKBA.

You can send them a letter of complaint and write to your local MP too.

a) bank statement that money has been deducted
b) Royal mail delivery confirmation note.

Can you please explain a little bit more about the complain procedure and how should I contact the MP.

with regards to contacting your local MP, you need to find their contact details by the area you live in.
