Hello
I am new to forum.i am on Tier 2 visa since 2012 jan and my present tier 2 visa is valid till 2015 .i am a doctor working for NHS and now I am switching my employer .my question is that do I need to pay for my dependent as I have 2 children whose visa is also valid till 2015 .well.if I switch my employer .will I get new visa validity beyond 2015 or will it be till 2015 .Can I claim visa fee from my employer or not

When you switch the new leave will be 3 years or the work end date on the new CoS if that is earlier.
The dependants' fee will be less if they apply at the same time as you.
Try to negotiate with the new employer that they reuimburse the application fee - this should be part of your salary/benefits package and is not an immigration matter.

thanks for reply .please can you tell me how long it takes for my employer to issue cos .Today when i spoke to them they told me that they have paid the fee for cos yesterday(27th june) and they should be able to get it today but they did not ,as i kept waiting for my employer email for cos.Does it take longer or there is any time limit .please do reply soon

if the employer has a CoS allocation for the current year it only takes about 20 minutes to assign a CoS online.

Thanks for quick response.you mentioned that it takes 20 mnts to assign a cos if they have allocation already but I am a gynaecologist and obstetrician and now this speciality is not in shortage of occupation list since 6 april2013 ,so do you think this could be the reason of delay in cos as they have to pass resident labour market test. (which they know very well as during interview i clearly told themand they kept the advertise for 28 days before interview)

Not sure what your question is. If an RLMT is needed the sponsor cannot assign the CoS until it has been completed because as part of the online process they have to provide details of the RLMT.

sorry for confusion but i mean to say that according to new list of shortage of occupation.obstetric and gynaecology is no more in the shortage of occupation of list ,so if they want to appoint any body who speciality is not on shortage of occupation list then they have to pass RLMT and one of the pre requisite for RLMT is that advertisement should be for 4 weeks which was there on NHS site and they could not find any other qualified candidate accept me so they offered the job to me. and during interview i clarified this to them and they told me that they know it that obst and gynaecology isnot in the shortage of occupation list. I m in uk presently and working on my first job stillwhich has visa validity till 2015(tier 2 general) ,so one of the pre requisite (advertisement) has already been full filled
now my question is that will it take long for them to assign certificate of sponsership .Myold and new employer is NHS butiI am switching my job for new emplyer which is a diffrent Trust . if they have to go through RTLM then how long it takes for them to issue a cos

If your prospective new NHS employer has not done the RLMT yet they will have to do it before they can assign the CoS to you. Assuming they have a CoS allocation the actual assignment process is online and can be done within ½ hour.

Thanks Manchi for very quick reply
Ispoke to them yesterday on phone and HR from trust told me that they have paid the fee for cos by credit card and once the payment is received by home office COSwill be issued but i am surprised because according to my understanding payment via credit card is immediate so why they are still waiting for payment confirmation

Dear Manchi I have another quarry as well apart from one which i already have put forwarded and waiting for reply
if my new job is for 12 months then how much much duration i will take on new cos .My previous extension is valid till 2015
if my new job is for 12 months initially then it will be extended then it means according to newCOS i will get short leave
please can any one help

If your application is successful your new leave will be to the work end date given in the CoS which is, as you said, approx. 12 months from now, + 14 days, and it will replace your current leave.
When the new leave expires, and provided you then get a new CoS, it can be further extended. The total time you can stay in the UK under T2G is 6 years counted from your initial entry clearance.

I am currently on a Tier 2 (General) visa and am currently looking for a change of employment. I will confirm with my new employer that they will sponsor my COS. Here are my questions:
(1) Does my PR clock get reset with the change in employment? (FYI: I have already been in the country for 2.5 years now with my current employer)
(2) Will the application need to be made from within the UK? Or will I have to go outside to make this application?

I have another querry that today i contacted mynew employer .they told me i will get my COS by the end of running week.please will you tell me how long it take for new cos ,according tomy understanding it should no tbe a problem if they already have allocated COS but Iam sure reason of delay is because they must have applied for allocation
does my previous employer woul know about my new employer as i dont want them to know about my new job
and please can u tell me wat could be the reason of delay of cos

Delay in Cos depends on many factors which is beyond ur employers control. Usually takes 7 working days max since card payments take time u should expect sometime this week secondly if u r working for nhs and changing employers u don't need to do rlmt as u already ve permission to work in tier 2

you are right i dont have to go through RLMT but my new employer does which is also nhs because i an obstetrician and gynaecologist and now in new list of shorttage of occupation list obst and gyan is not in that list so my new employer has to undergo RLMT but not my old employer if they extend my visa
I am sure if I am wrong somebody will correct me

hello
please can any one answer
I got my cos issued and i am getting a primium appointment in a week time so if my application for new employer is approved then how can i get it done for my kids who are not in uk as they have gone to india due to school holidays in uk
they are on my sponsership so will be a matter i f i apply for them when they come back or should i wait for them to come back to uk and then i should aplly together
please early reply will be appreciated

hi am working in NHS
I have been issued new COS by another employer and my new employer is a diffrent trust but it comes under nhs
i dont want my present employer to know that where i am going for new job
but i am worried will they come to know automatically through home office or through my new employer .Reason why I dont want them to know is because HR from my present employer is very rude and i had a fight with them because of annual leave issueas they cancelled my few annual leave because of staff shortage .I am worried that if they come to know about my new job ,then they might create problems
please an early reply will releive my anxiety

It wasn't a good idea to resign before approval by the HO of your new grant of leave application but that cannot be undone now. Make absolutely sure that your application is correct and nothing is missing.
There is no reason why the HO should inform your current sponsor about the identity of your prospective new employer but since both your current and new employers are part of the NHS there is no way of knowing if any contact has been made internally, e.g. for references.

thanks for replying.I resigned it because i was told that i need to have adate that when can i start my new job before going to home office on day of premium appointment and although my notice period is 3 months but i have requested my hospital to releive me earlier which they are considering so i thought if they releive me early and if i put a date late for start then it willbe a problem
suppossing my old employer releive me on 6th sept and if i tell HO that i will be releived on 1st oct according to rules( as my notice period is under consideration for ealy releiving)then what would have been my status between 2sept and 1st oct
this will be my second extension for the job as previouly i got extension till 2015 for tier 2 with my previous employer and now new COS visa is till 2016 by new employer
please do let me know waht documents are needed

The HO is not interested in your notice period. There is a work start date stated in the CoS and if your application is approved you can continue in your current job until that date but not beyond.

thanks again but my work start date was 1st August and when i spoke to my newemployer that this date is not possible they said it will not effect as once ur notice period is decided you can call us and we will give a letter mentionning ur work start date .only thing they emphasized was to get visa done bfor 5 th of oct as it is the expiry date of cos
