set (M) OR flr (m)-Urgent Please help.

Hello Please help,

I know, other might have asked similar question just to calm my nerves.
My husband was on Tier1 and I on tier 1 dependent, both came in 2008. We both would eligible for Ilr next month. Our visa will expire on Oct 2013. I need to travel home for family emergency, just before our PEO appointment . Can my husband proceed without me for his ILR and can I travel back to Uk with my existing dependent visa and apply for ILR using the the SET(M) form or do i need to use the FLR(M). Can you please please respond.

We are looking for dates but if we apply jointly the dates are not available easily but it seems to be easier to get dates, if he applies alone. I need urgently travel abroad, so cant wait.

Thank you in anticipation of your help.
If your spouse is granted ILR as a PBS then you can apply for settlement on set(o) once you complete your 2 years (already done it appears).You can travel on your visa and apply before your visa expires for settlement providing your spouse is settled (granted ILR as a PBS) and you have the 2 years qualification with proof of cohabitation.
