Tier 4 extension

Is it possible for someone with an outstanding appeal from tier 4 to tier 1 enterpreneur apply under the tier 4 category in country and the withdraw the appeal process. All fees have been paid,Cas has been issued and he has his matainanace fund in the bank.
Pls your prompt responses will be very much appreciated.
