Please advise me what benefits can I claim because I have been ill and still on sick leave since June 2012 and my employer stop my SSP last December 2012. I was granted ILR last month. I'm still not back to work because of illness, what benefits can I claim and where? Thank you.

When you SSP finishes you should claim Employment and Support Allowance (ESA) and you may possibly be entitled to Personal Independence Payment (PIP). You may also be entitled to Housing Benefit and Council Tax Reduction. Moreover, if you were ill due to an industrial disease or accident there may be other avenues. You should visit your local Citizen Advice Bureau who will be able to help. If you have a partner who is subject to immigration control you should ensure than any benefits only include a single person applicable amount unless they are from an exempt Country.

Thank you so much for your reply. Do you think applying benefits will not affect my husband's outstanding FLR(M) application and my future application for naturalisation?

No, providing you do as I stated, inform that your husband is subject to immigration control and ensure you are awarded a single person amount but that the applications are joint where necessary. I assume your husband works?

What date shall I write for ESA claim? Because my last SSP was December 2012 and I just receive my ILR approval last 23rd May 2013. Shall I write after my ILR approval?

Contribution based (CB)ESA could be claimed before your ILR so if you are eligible for (CB)ESA then put the earlier date.

If you've paid national insurance contributions over the last 2 tax years then you should be eligible for contribution based ESA. (CB)ESA is non means tested and not prohibited if you're subject to immigration control. If so, then put the date your SSP stopped but remember ESA can only be backdated 3 months.

Hello Amber good day just want to ask about tax credit. I applied for tax credit and the form arrived. I would like to claim for myself only but it says in the form that couples must claim tax credits jointly. My husband still subject to immigration control, will there be an effect on his outstanding FLR (m) application or future ILR application?

No, as you are not subject to immigration you can and indeed must claim as a couple if you are living as a couple.

Thank you. There's also a question in the ESA1 form if I have a carer. Shall I put my husband as my carer because even he is working he is the one who looks after me. If I will put him as my carer will he receive carer's allowance and is it safe?

He will not receive Carer's Allowance, the reason they ask if you have a carer is to evaluate your needs.

Dear Amber,
I just received my ILR approval last June 2013 with my husband and 10 years old child born abroad.
Could you please advise on what benefits can I claim and when?
(my husband is out of work)
Thanks in advance

Are you working? I gather you all have ilr. You should be putting in a claim for child benefit and tax credits. If your husband was working previously and or you are not working full time then your husband should claim job seekers.

Many thanks for your prompt reply.
Yes, we all have ILR and I am working full time as a structural engineer but my husband has never been employed since we arrived in the UK in 2008.
Thanks

Oh well job seekers is not going to be relevant. Child benefit and tax credits, depending on income, will more than likely be all.

if your husband has never worked since living in the UK he wouldn't be able to claim contribution based job seekers allowance, and he wouldn't be entitled to income based job seekers allowance as your income is too high.
Either you or your husband can claim child benefit. It may be better for your husband to claim for now as he is out of work and if he claims child benefit whilst your child is under 12 if can help to protect his state pension in the future. See
http://www.hmrc.gov.uk/childbenefit/sta ... ension.htm
Child tax credits have to be claimed in joint names although you probably won't be entitled to them if you earn 34K a year.
