ILR Dependent Query

Post by m.asif » Sun Jun 23, 2013 7:33 pm

Hi All,

I am currently on Tier 1 (General) and will be applying for 10 year ILR next year in April. My wife is on Tier 1 dependent visa since December 2009.
I'll be grateful if someone can answer my below questions.

1) She is going to travel of UK for around six months (Sept-Mar). Would it have any impact on her application next year? (absence from UK)

2) Once I'll get my ILR what visa she need to apply?

Thanks in advance.

As you will be settling under long residence and your wife is on a pbs dep (route to settlement) and has been since before July 2012 she should apply for flr(m) under part 8 when you settle (are granted set(lr)). If she has satisfied the two year qualification period (time on pbs dep can count) then she can apply to settle on set(m) immediately following flr(m) being granted.

However, if you can apply for settlement as a PBS applicant (as apposed to 10 year applicant) then your wife could apply to settle at the same time and it would be cheaper and could be quicker.
